The legislation on prostitution has not been formulated to define or restrict on what activities can be considered to constitute brothels and what activities cannot. For instance, in the United States, the law does not distinguish between forcing sexual services and pimping (selling sex).

There is no doubt that prostitution is an act of force and exploitation of the prostitution industry. However, there is no justification in international law for States to criminalize conduct that only employs adults who are brought into the country through illegal means and who are subjected to undesirable practices such as forced labor and forced prostitution. Such a practice flies in the face of what most civilized societies regard as human rights.

In addition to these problems in international law, the prostitution legislation has also been questioned on the basis of its definition of prostitution and the various States which have adopted different approaches. For instance, the Nordic countries, in which prostitution has been legalized since the year 1999, differentiate between ‘the profession of prostitution and unnatural sex’.
